This article critically examines the rationales for the well-settled principle in sentencing law that an offender’s remorse is to be treated as a mitigating factor. Four basic types of rationale are examined: remorse makes punishment redundant; offering mitigation can induce remorse; remorse should be rewarded with mitigation; and remorse should be recognised by mitigation. The first three rationales each suffer from certain weaknesses or limitations, and are argued to be not as persuasive as the fourth. The article then considers, and (...) rejects, two arguments against remorse as a mitigating factor in sentencing: that the crime, not the offender, is the focus of punishment; and that the truly remorseful offender would not ask for mitigation. The article concludes with a brief consideration of whether a lack of remorse should be an aggravating factor. (shrink)

Counterfactual thinking involves the imagination of non-factual alternatives to reality. We investigated the spontaneous generation of both upward counterfactuals, which improve on reality, and downward counterfactuals, which worsen reality. All subjects gained $5 playing a computer-simulated blackjack game. However, this outcome was framed to be perceived as either a win, a neutral event, or a loss. "Loss" frames produced more upward and fewer downward counterfactuals than did either "win" or "neutral" frames, but the overall prevalence of counterfactual thinking did not (...) vary with outcome valence. In addition, subjects who expected to play the game again made more upward counterfactuals and were less satisfied with the outcome than were subjects who did not expect to play again. However, once subjects saw the cards from which they could have selected had they "hit" again (two winning cards and two losing cards), all subjects generated primarily upward counterfactuals and showed a corresponding decrease in satisfaction. These results implicate both cognitive and motivational factors in the generation of counterfactuals and tell us something about the functional value of counterfactual thinking: downward counterfactuals provide comfort; upward counterfactuals prepare one for the future. In a companion review1 we discussed the data supporting the conclusion that at least two subtypes of spectrin exist in mammalian brain. One form is found in the cell bodies, dendrites, and post‐synaptic terminals of neurons (brain spectrin(240/235E)) and the other subtype is located in the axons and presynaptic terminals (brain spectrin(240/235)). Our recent understanding of brain spectrin subtype localization suggests a possible explanation for a conundrum concerning brain 4.1 localization. Amelin, an immunoreactive analogue of red blood cell (rbc) cytoskeletal (...) protein 4.1, is localized in neuronal cell bodies and dendrites when brain sections are stained with antibody against rbc protein 4.1. However, it has recently been suggested that synapsin I, a neuron‐specific phosphoprotein associated with the cytoplasmic surface of small synaptic vesicles, is related to erythrocyte 4.1. In this review we hypothesize that there are at least two forms of brain 4.1: a cell body/dendritic form (amelin) which is detected with rbc protein 4.1 antibody, and a unique form found exclusively in the presynaptic terminal (synapsin I). The binding of synapsin I to brain spectrin(240/235), and its ability to stimulate the spectrin/F‐actin interaction in a phosphorylation‐dependent manner suggests a model for the regulation of synaptic transmission mediated by the neuronal cytoskeleton. This study explores the prevalence and predictors of three sexual contact and conduct risks through mobile phone use among adolescents : the exchange of sexually explicit content, the sharing of one's mobile phone number with a stranger from the opposite sex, and participation in anonymous chat rooms on TV. One in three adolescents admits having exchanged sexual content, one in five reports having shared their number with a stranger, and one in ten has participated in TV chat rooms. Contextual predictors (...) were gender, age, having a partner, self-esteem, popularity, susceptibility to peer pressure, parent attachment and attitude towards school. Strong mobile phone use predictors were the frequency of text messaging, problematic phone use and using one's phone to avoid face-to-face interactions. However, different patterns emerged for the different mobile phone practices and for girls and boys, indicating the need for further research. (shrink)

Effects of perceived control and close alternative outcomes were examined. Subjects played a computer-simulated "wheel-of-fortune" game with another player in which two wheels spun simultaneously. Subjects had either control over spinning the wheel or control over which wheel would determine their outcome and which would determine the other player's outcome. Results showed that (a) subjects generated counterfactuals about the aspect of the game that they controlled, (b) the direction of these counterfactuals corresponded to the close outcome associated with the aspect (...) they controlled, and (c) close counterfactuals predicted affective responses to the outcome of the wheel spin. Cognitive and motivational implications of the influence of perceived control on counterfactual generation are discussed. (shrink)

Stoicism is now widely recognised as one of the most important philosophical schools of ancient Greece and Rome. But how did it influence Western thought after Greek and Roman antiquity? The question is a difficult one to answer because the most important Stoic texts have been lost since the end of the classical period, though not before early Christian thinkers had borrowed their ideas and applied them to discussions ranging from dialectic to moral theology. Later philosophers became familiar with Stoic (...) teachings only indirectly, often without knowing that an idea came from the Stoics. The contributors recruited for this volume, first published in 2004, include some of the leading international scholars of Stoicism as well as experts in later periods of philosophy. This paper takes as its point of departure recent research into the possibility that human beings can perceive single photons. In order to appreciate what quantum perception may entail, we first explore several of the leading interpretations of quantum mechanics, then consider an alternative view based on the ontological phenomenology of Maurice Merleau-Ponty and Martin Heidegger. Next, the philosophical analysis is brought into sharper focus by employing a perceptual model, the Necker cube, augmented by the topology of the Klein bottle. (...) This paves the way for addressing in greater depth the paper’s central question: Just what would it take to observe the quantum reality of the photon? In formulating an answer, we examine the nature of scientific objectivity itself, along with the paradoxical properties of light. The conclusion reached is that quantum perception requires a new kind of observation, one in which the observer of the photon adopts a concretely self-reflexive observational posture that brings her into close ontological relationship with the observed. General relativity is commonly thought to imply the existence of a unique metric structure for space-time. A simple example is presented of a general relativistic theory with ambiguous metric structure. Brans-Dicke theory is then presented as a further example of a space-time theory in which the metric structure is ambiguous. Other examples of theories with ambiguous metrical structure are mentioned. Finally, it is suggested that several new and interesting philosophical questions arise from the sorts of theories discussed.

Aspects of an example of simulated shared subjectivity can be used both to support Steven Lehar's remarks on embodied percipients and to triangulate in a novel way the so-called “hard problem” of consciousness which Lehar wishes to “sidestep,” but which, given his other contentions regarding emergent holism, raises questions about whether he has been able or willing to do so.

This paper seeks to extend my recent work on quantum perception (Rosen, 2021) to the phenomenon of quantum entanglement. In the first section, I summarize the earlier work, noting how the conventional approach to observing photons is rooted in an objectivist philosophy that serves as an obstacle to probing the underlying quantum reality. In the summary provided, I bring out the intimate relationship between observer and observed in the quantum world, and the need for a new, proprioceptive mode of observation (...) linked to phenomenological philosophy. The second part of the paper builds on the earlier effort by applying the proprioceptive observation of photons to the phenomenon of entanglement. The basic proposition is that proprioceptive observers of entangled photons may become entangled with each other. I propose an experiment that tests this hypothesis. In concluding, I explore the possibility that a quantum internet of proprioceptively engaged participants could create an ontologically entangled society. (shrink)

On 30 June 1994 the Social Democratic Party of Japan (SDPJ, formerly the Japan Socialist Party) joined its historic enemy, the Liberal Democratic Party (LDP), to form a coalition government in a Japanese equivalent of Italy's . Competition between the conservative LDP and the progressive socialists had defined the Japanese party system since 1955. In this paper we analyze voter reactions to this and other confusing events surrounding the end of the LDP's 38-year dominance. We find, first, that the Japanese (...) electorate was able to make sense of these events. The political space reflected in public opinion mapped the political space reflected in the mass media remarkably well. Secondly, our findings support the idea that attitudes toward political parties are endogenous to the political process: strategic moves by political actors alter the political space within which they maneuver. Coalitions of strange bedfellows force voters to revise their perceptions of political space and reevaluate their attitudes toward the actors involved. Strange bedfellows seemed less strange, friendlier after they had been seen in bed together. (shrink)

This paper reports key processes in interviewing children in a highly constrained setting in which many features of effective interviewing children were either absent or were contradicted, and in which many aspects of the interview situation rendered them potentially uncomfortable for the children. The children left feeling positive about themselves and the interviews, having given frank and useful research data. The paper reports the strategies used by the interviewers to bring about these positive outcomes. It reports 10 steps, which the (...) interviewers took whilst working within the constraints, to make the interviews effective and positive by rendering the strange familiar and by attending to the all-round quality of the qualitative interviews. The paper makes recommendations for interviewing children and how researchers can operate within children?s frame of reference and their expectations of adult behaviour and the interview situation. Rather than immediately moving to defend the much-challenged notion of natural law, or to outline a positive account of the latter, he (...) considers the recurrent questions that render natural law theory a permanent feature of the speculative landscape. After all, in one sense anyone who is convinced that there is a morally normative natural order-that some things " by nature " are unjust-is a "natural lawyer." The same phenomenon that nourishes sceptical impulses-diversity in customs and moral convictions-renders ineluctable the asking of the question whether any of the competing customs or moral tenets is ratified by the evidence of nature. As Simon puts it: There would be no eternal return of natural law without an everlasting opposition to natural law. Again, this opposition thrives on the contrast between the notion of actions that are right or wrong by nature, and the lack of uniformity which we observe in actual judgments.1 · Yet as Simon later observes: There is a rumor that modern ethnology has demonstrated the absence of uniformity among peoples in matters of so-called natural law. That is rather naive. This lack of uniformity was well known long, long before what is called modern science came to exist. The subject of natural law is, Simon insists, difficult because it is engaged in an overwhelming diversity of doctrinal contexts and of historical accidents. It is doubtful that this double diversity, doctrinal and historical, can so be mastered as to make possible a completely orderly exposition of the subject of natural law.4 As Dr. Russell Rittinger points out in his introduction to the volume, Simon is aware that there is not merely one " tradition" of natural law, but several.5 The contrast between convention and nature is susceptible of quite diverse formulations, and these are in large part dependent upon social and institutional factors. Nonetheless, in Simon's focus upon the doctrinal and historical problematic of natural law theory, he achieves the difficult feat of elucidating root speculative questions. As he puts it: an ideology is a system of propositions which, though undistinguishable so far as. expression goes from statements about facts and essences, actually refer not so much to any real state of affairs as to the aspirations of a society at a certain time in its evolution.
